Philadelphia Jury Awards $42.9 Million Verdict in Premature Birth Case

A Philadelphia jury recently awarded a local family a $42.9 million verdict in a medical malpractice case involving the premature birth of a child. As a result of the premature birth and the negligence of treating physicians, the child suffered from multiple physical and cognitive impairments, including mental retardation, blindness, and spastic quadriparesis, among other serious conditions. In turn, the family has suffered considerable financial and emotional damages associated with caring for the disabled child.

The verdict for Harris v. Chestnut Hill Hospital was awarded on December 20 in the Philadelphia Court of Common Pleas and resolved a case that stems back to 2007. According to court documents, treating physicians failed to admit the child's mother to the hospital in a timely fashion. Subsequently, they failed to administer IV steroids that would have protected the newborn's brain and respiratory development.

As a result of the jury verdict, the child's parents have received justice by holding the treating physicians accountable for their child's impairments. Additionally, the funds will provide the necessary means to support and care for a child who has profound disabilities. Such a case is demonstrative of the power of the judicial system and the rights of victims and families who suffer preventable damages at the hands of negligent medical practitioners.
