$22 Million Lawsuit: Doctor Error During Surgery Results In Patient Paralysis

surgical toolsA current medical malpractice lawsuit seeks $22 million in damages in a case in which the doctor was accused of dropping two surgical instruments onto a patient’s spine during surgery to relieve a pinched nerve, causing paralysis. The man was paralyzed from the neck down.

According to the lawsuit, Dr. Clifford Lin, M.D. allegedly dropped the instrument on the spinal cord twice, resulting in quadriplegia, incontinence, physical pain, and loss of enjoyment of life. Nobody is discussing the type of instrument or how exactly the doctor dropped it and caused the injury. A spokesperson for Oregon Health & Science University, the other defendant in the case, said that they will not comment on the case out of respect of patient privacy laws and the legal process.

In the claim, the patient stated that he requested his medical records following the March 11th surgery, but was denied because OHSU said the signature on the request did not match the signature on the file prior to surgery. The plaintiff claimed to retain slight control over his hands despite the paralysis. He decided to file the lawsuit four months after the incident.

The plaintiff is seeking $10 million for pain and suffering, $10 million for future medical bills and home modifications, and $2 million for current medical expenses.
