Medical malpractice jury verdicts have hit a 15-year low in the state of Pennsylvania since the Administrative Office of Pennsylvania Courts began reporting figures in 2000. Last year, there were 101 medical malpractice cases tried in state courts, reflecting a 20 percent decrease from the previous year, and a nearly 70 percent drop from the number of cases each year between 2000 and 2003.
Of the cases tried in 2015, juries returned a defense verdict in 79 cases. Four nonjury verdicts also resulted in defense verdicts. The other cases were resolved as follows:
- Three awards less than $500,000
- Two awards between $500,000 and $1,000,000
- Twelve awards between $1,000,000 and $5,000,000
- Three awards between $5,000,000 and $10,000,000
- Two awards greater than $10,000,000
Medical malpractice attorneys are attributing the consistent decrease in the number of lawsuits to the increasing costs of litigation and the use of alternative dispute resolution, including mediated and binding arbitration with high-low agreements.
