Veterans Affairs will pay the largest FTCA medical malpractice case settlement in the history of New Hampshire to a client of The Law Offices of Dr. Michael M. Wilson M.D., J.D. & Associates. The claim, filed by the wife of a disabled veteran, argued that the VA hospital failed to properly treat her husband for a stroke, resulting in a devastating medical condition called LIS (Locked-In Syndrome).
According to the suit, “It is a basic principle of medicine that a patient who has suffered a stroke is generally at an elevated risk of suffering a second stroke.”
However, doctors at the New Hampshire medical facility failed to maintain this standard of care.
Six weeks after his first stroke, the man suffered a second one, which resulted in LIS. LIS is a severe condition where the patient is conscious but has no voluntary muscle movement, including very limited movement of the eyes and head.
With the help of expert witnesses, two attorneys from The Law Offices of Dr. Michael M. Wilson, M.D., J.D & Associates, Jamal Alsaffar, and Tom Jacob, demonstrated that doctors at the VA hospital failed to prevent the second stroke.
The court determined that VA will pay $21,568,710 to the plaintiff on behalf of her husband. This is the largest settlement of its kind in New Hampshire.
