A jury in Cuyahoga County, Ohio recently awarded a $14.5 million medical malpractice verdict to a boy and his mother after the boy suffered serious birth injuries. The trial, which lasted two weeks, resulted in a favorable verdict for the victim and the family and supported the plaintiffs’ claim that Metro Health Medical Center and a treating physician provided a substandard level of care.
The case involved a Garfield Heights boy – now 11 – and his mother who had first filed their lawsuit in 2004. The lawsuit was initially dismissed in 2006 and later refiled in 2011. According to court documents, the mother was admitted to MetroHealth several times in the span of a few days after going into labor. Rather than keeping her in the hospital, she was allowed to return home.
Shortly after, her water broke and she was admitted to the hospital, where she requested a C-section. Her previous pregnancy – 11 years earlier – resulted in an emergency C-section weeks before full-term. Despite her requests, the attending obstetrician did not perform a C-section because monitors showed the baby was healthy. After the baby began showing signs of distress, an emergency C-section was performed. However, the baby suffered a massive brain hemorrhage.
The jury ultimately found that the doctor had been negligent for not informing the mother about risks, not discussing options, and not granting the mother’s request for a C-section. As a result of the birth injury, the boy now has cerebral palsy, and suffers from cognitive delays, visual impairments, and other medical issues that will necessitate lifelong care. The jury award covers past economic losses, pain and suffering, cost of services, and costs of future care.
